Terms of Service & Content Policy

1. Agreement to these terms

amos (the "Service") is operated by Shiver LLC, a Wyoming limited liability company ("amos," "we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use amos. By using the Service you represent that you are 18 or older, that you have not been convicted of a violent or sexual offense, that you are not required to register as a sex offender, and that you have not previously been removed from the Service. We may terminate any account that violates these requirements.

3. Your account

You agree to provide accurate information (including your real age), to maintain only one account, and to keep your account credentials secure. You are responsible for all activity on your account. Impersonating another person is prohibited.

4. Zero tolerance for objectionable content

amos has zero tolerance for objectionable content or abusive behavior. The following are strictly prohibited and result in immediate removal:

Harassment, stalking, threats, or intimidation of any person
Hate speech or content that degrades or discriminates
Any sexual content involving minors, or any interaction with minors
Impersonation, scams, solicitation, or commercial spam
Sharing another person's private information without consent
Illegal activity of any kind, including solicitation of illegal services
Nudity or sexually explicit photos in profile content

We may review, remove, or refuse any content and may suspend or terminate accounts at our sole discretion, with or without notice.

5. Your content

You own the content you post (photos, profile text, messages). By posting it you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely to operate and improve the Service. You represent that you have the right to post everything you post and that it does not violate any law or any third party's rights.

6. No background checks; interactions are at your own risk

WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR IDENTITY VERIFICATION ON USERS. We make no representations or warranties about the conduct, identity, intentions, or compatibility of any user. You are solely responsible for your interactions with other users, whether online or in person.

YOU ASSUME ALL RISK ASSOCIATED WITH MEETING OTHER USERS IN PERSON. Meet in public places, tell someone where you are going, stay sober, and never send money or share financial information with other users. We are not responsible for the conduct of any user on or off the Service.

7. Location

The Service displays your position to other users only after offsetting it by roughly 120 meters; exact coordinates are never shown. Location display is approximate, provided for discovery purposes only, and may be inaccurate. Do not rely on the Service for safety- or navigation-critical purposes.

8. Subscriptions & billing

amos+ is an auto-renewing weekly subscription billed through your Apple ID at the price shown at purchase. It renews automatically until canceled at least 24 hours before the end of the current period, in iOS Settings → your name → Subscriptions. Except where required by law, payments are non-refundable; refund requests are handled by Apple. Prices may change with notice; continued renewal after a change constitutes acceptance. Free connection allowances, limits, and feature availability may change at any time.

9. Termination

You may stop using the Service and delete your account at any time in the app. We may suspend or terminate your access at any time, with or without cause or notice, including for any violation of these Terms. Sections 5–6 and 10–14 survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT OR INFORMATION (INCLUDING LOCATION INFORMATION) IS ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMOS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS — ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless amos and its owners, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms or any law.

13. Dispute resolution — binding arbitration & class action waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before filing any claim, you agree to contact us at support@amos.live and give us 30 days to attempt to resolve the dispute informally.

Arbitration. Any dispute not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

CLASS ACTION WAIVER. YOU AND AMOS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity.

Opt-out. You may opt out of this arbitration agreement by emailing support@amos.live with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles, except where the law of your state of residence grants you non-waivable consumer rights. Where arbitration does not apply, exclusive venue lies in the state or federal courts of Wyoming.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated in the app or on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance.

By using amos you agree to these Terms, our zero-tolerance content policy, and our Privacy Policy. Continued violations result in permanent removal.
